These terms govern your use of nhdHost services. By using our services, you agree to these terms. If you don't agree, please don't use our services.
1. Your Account
When you create an account with us:
- You must provide accurate and complete information
- You're responsible for keeping your login credentials secure
- You're responsible for all activity under your account
- You must be at least 18 years old (or have parental consent)
If you notice any unauthorized access to your account, contact us immediately.
2. Our Services
We provide web hosting, VPS hosting, and related services. We'll do our best to keep your services running smoothly, but we reserve the right to:
- Modify or discontinue services (with reasonable notice when possible)
- Perform maintenance that may temporarily affect availability
- Update pricing with 30 days notice for existing customers
3. Acceptable Use
You agree not to use our services for:
- Illegal activities — Anything that violates local, state, or federal law
- Spam — Sending unsolicited bulk email or messages
- Malware — Hosting viruses, malware, phishing sites, or similar harmful content
- Copyright infringement — Hosting content you don't have rights to
- Abuse — Attacking other systems, attempting unauthorized access, or harassing others
- Resource abuse — Using excessive resources that impact other customers
We reserve the right to suspend or terminate accounts that violate these rules, sometimes without prior notice for serious violations.
4. Payment Terms
- Fees are due in advance according to your billing cycle
- We accept payment via the methods listed in our billing system
- Late payments may result in service suspension
- Prices may change with 30 days notice
5. Refunds
We offer refunds under these conditions:
- New hosting accounts may be eligible for a refund within the first 30 days
- VPS services are generally non-refundable due to resource allocation
- Refunds are not available for accounts terminated for policy violations
- Domain registrations are non-refundable
Contact support to discuss refund requests—we'll try to be reasonable.
6. Uptime Guarantee
We guarantee 99.9% network uptime. If we fail to meet this:
- You may be eligible for service credits
- Credits must be requested within 7 days of the downtime
- Scheduled maintenance doesn't count against uptime
- Events outside our control (natural disasters, etc.) are excluded
7. Backups
While we perform regular backups of our systems, you are responsible for maintaining your own backups. We strongly recommend keeping independent backups of all important data. We are not liable for data loss.
8. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, or consequential damages
- Our total liability is limited to the fees you paid us in the 12 months before the claim
- We provide services "as is" without warranties of any kind beyond those explicitly stated
9. Termination
Either party can terminate services:
- You can cancel anytime through your account or by contacting support
- We may terminate for policy violations or non-payment
- Upon termination, you should download your data—we may delete it after a reasonable period
10. Changes to Terms
We may update these terms occasionally. For significant changes, we'll notify you via email or through our website. Continued use of our services after changes means you accept the new terms.
